Is KHP alive?

While doing a Nicheclip search I encountered the following site

http://www.istudio.com/vi/22380

Anybody heard of these guys? Are they thieves from KHP ?

Definitely looks like stolen content used to pad a portfolio of some sort. The Niche link is old and now goes to a Crush Site. So it was just a copy and paste hack job.

The site is an exact copy of Modelmayhem. There are link the bottom of the page for contacting. Perhaps someone should send this link to KHP if anyone is still in contact with him.

I am not in contact with Paul KHP now for years.

'Who Is' is showing they are from the UK and subject to the laws there - 6 years in prison. The actual location appears to be Vietnam.

However, I bet it is or was Paul KHP since the location shown could be his:

I doubt that it's Paul, but I've emailed the info to him anyway, so that he can decide whether or not he wants to enforce his copyright. I am still in communication with him. He's still trying to save my soul, notwithstanding that I've assured him that my soul is quite safe already. :D

An interesting issue because (correct me if I am wrong) to take action for copyright one would need to show that the breach caused a loss. As Paul has dropped right out and isn't marketing anything directly or indirectly then piracy won't affect him. I suppose what I am saying is that at least his excellent stuff will be reaching an appreciative audience by the only means now available?

Actually, you just have to show ownership and that someone is stealing your work and using it without permission. If I painted a picture that I was never planning to sell, and it was stolen and placed in someone else's home, I would still be able to claim copyright. It is mine regardless of perceived value. It the case were that you always had to show a money trail, many, many artists would be at risk of having their creations or words taken away from them because someone else simply liked it and wanted it for themselves.

Copyright laws protect the artist in that they affirm that what that artist created, regardless of value, it theres and theres alone to have and hold, sell, give, etc. But, no one else should be able to make that decision for them, less we give up our freedoms completely.

I have often heard of pirates justifying taking artist work because the artist is no longer active. But, what they don't understand is it is not always about money. It is more about respect then anything else. Even if I thought Paul was a narcissistic putz, I would still respect everything he created and could never justify taking it, unless he gave permission for me to do so.

When a chair is sitting in someones front lawn, you see it. You appreciate it. But, until the day the owner placed a sign on it that says "free", you don't take it from them.

I hope that made sense. It is early morning and I still have not had coffee.

Makes some sense John, but the situation here is that Paul has disowned his work and has apparently destroyed all his original stuff. In those circumstances I can't see him complaining (or even being aware) if it's pirated. And with that knowledge I am not sure the community ought to do it for him, with all due respect?

Outside the laws, that would sound like the case. But, at least with regard to copyright, unless he passes ownership, he even has the right to forbid anyone from ever seeing it.

If he disowns it, but passes ownership to the public domain, that is a different story. Then, no problem. But, in this case, he owns it and does not want anyone to see it. He is still controlling what happens to it and he does not want it available at all.

But, of course, what one wants to happen and what really happens are two separate things. And, while I respect his wishes with regards to defending his right to ownership an control of his art, if he does not make an effort to police what does get out, there is not much that can be done.

I work everyday getting my pirated materials removed. It is part of my work day. I accept that. His stuff is everywhere and if he cares, but does nothing, then there is only the law I can state. Ultimately, the words of the law will do nothing unless he backs them up with action.

It is just the way it works.

Dennis,

Apparently, iStudio was originally a cloned template from Modelmayhem. As it turns out, OMP (onemodelplace) bought them. OMP is a huge competitor to MM----OMP is the #1 modeling site in the world. What is funny is when I do a search for Oregon models in iStudio, I find several that also have profiles on Modelmayhem. But, the fact that iStudio is a tie in with OMP, but a clone of their competitor MM is very curious.

Just musing,

JohnM,

Thanks for the information. This entire matter is curious and I suspected Paul could have placed this add before he quit and they didn't remove it. This fits time frame of the domain since it was registered in 2001 and renewed in 2010 but to expire in about 3 months - Feb 2/12 . I always renew mine about 3 months or more before they expire to be on the safe side so I don't forget, so makes wonder if it is going to be renewed. I will check then if this is still an issue.

Pirated KHP videos will sometimes be taken down if I say they are mine. On Dark Fetish Network I just ask Sergey to take them down as well as other out of business producers' videos. A new moderator Vicious-Vixen is there about 20 hours per day (she said she has no life : ) will take down any Out of Business community producers video plus any active producers video that isn't active on the site in usually 10 minutes of me reporting it. I advise the other active producers that one of their videos is posted as they do for me.

A tennet of law is "He who sits on his rights, loses them...". This may not be applcable to copyrights.

Since KHP was an active producer and an icon on this forum, it seems prudent for members to offer their observations. Action still rests with KHP.

PennPaul,

You mean if I see KHP or any other out of business Producer's video (mostly Orgasmia the owner of NicheClips) posted on DFN - I am Not to have them taken down? In addition, You want the members here to decide with "their observations" what is proper and legal ? In other words, pit me against the posters here. How about you tell what the fuck you want me to do - Man Up!
